As was observed, the criminal justice system has made a mockery of itself through lame ass enforcement and the coddling of "first-time" offenders, which has emboldened them and allows them to laugh at the idea of law enforcement every day.

Talk to any police officer and you will discover that non-violent offenders are almost never put in jail. This encourages career criminals who then assume they will never suffer any reprisal and go on to commit the violent crimes so that they can finally end up in prison. We are not talking about speeding tickets or pot possession here. We are talking about crimes that victimize people every day which go unpunished and as long as the criminal is willing to plead guilty to up the stats for the DA he can resume business as usual.

If we can not work this out, then we have no business turning another huge portion of the population into criminals violating laws that will not or can not be enforced due to no room in prisons.
